What these terms cover These terms apply to the HubSpot theme **Gatehouse - Member Portal and Login Pages** ("the theme"), offered by All Gusto through the HubSpot Template Marketplace. By installing or using the theme, you ("the buyer") agree to these terms. HubSpot's own terms (including the HubSpot Marketplace Terms of Use and HubSpot Customer Terms of Service) govern your use of HubSpot itself. These terms cover only the theme. The optional Gatehouse data pack is not part of the marketplace theme and is not covered by these terms. It is installed separately under its own arrangement with All Gusto. ## 2. What the theme is The theme provides layout, header and footer, colors and fonts, sign-in, registration and password pages, a password prompt page, a 404 page, and member page templates for use on your own HubSpot website. It runs inside your HubSpot account. Setup instructions are in the setup guide at [https://allgusto.com/gatehouse/setup-guide](https://allgusto.com/gatehouse/setup-guide). ## 3. License All Gusto grants you a non-transferable license to use the theme in one HubSpot account. You may modify the theme files for use in that account. You may not resell or redistribute the theme, in original or modified form. All Gusto keeps all ownership and intellectual property rights in the theme. Your license does not transfer ownership. ## 4. Price, payment and refunds The theme costs $599 and is purchased through the HubSpot Template Marketplace. Payment is processed by HubSpot and the payment provider connected to All Gusto's marketplace account. If the theme does not work as described, you may request a refund within 14 days of purchase, subject to the HubSpot Marketplace refund policy. ## 5. Support and updates Support is free and provided in English by email at [info@allgusto.com](mailto:info@allgusto.com). While the theme is listed on the HubSpot Template Marketplace, All Gusto provides bug fixes and updates for the theme as supplied. Customization and setup work are not included and are billed separately. ## 6. Your responsibilities You are responsible for your HubSpot account and its settings, including your HubSpot subscription, private content and membership settings, access groups, forms, files and the content and data you publish. The theme runs inside your HubSpot account; All Gusto does not operate or have access to your account through the theme. You may not use the theme for any unlawful purpose. ## 7. Warranty The theme is provided as is, except that All Gusto warrants that it works as described in the listing and the setup guide. All Gusto does not make any other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. ## 8. Limitation of liability All Gusto's total liability arising from the theme is limited to the fees you paid for it. All Gusto is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption, even if advised of the possibility of such damages. ## 9. Termination If you breach these terms, your license ends. On termination you must remove the theme from your HubSpot account. ## 10. Changes to these terms All Gusto may update these terms by posting a revised version with an updated effective date on this page. The revised terms apply from that date. ## 11. Governing law and disputes These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these terms or the theme will be resolved in the state or federal courts located in Brevard County, Florida, and you consent to that venue. ## 12.
